General Terms and Conditions of BioVaria Attendance

  1. The contract established according to your registration is solely governed by these terms and conditions. Any conflicting terms and conditions are not accepted and hereby excluded.

  2. By confirming your registration you make a firm offer to the conference organizer Ascenion GmbH with its principal office at Herzogstrasse 64, 80803 Munich, Germany (in the following "Ascenion") for your attendance at Biovaria 2017 according to the data which you submitted. Acceptance of your offer will be made by Ascenion by sending a confirmation email to the email address which you provided. Ascenion will assume that you are allowed to use this email address for registering at Biovaria 2017. If you have not received your confirmation email within 72 hours, please contact Ascenion by email at info(at)biovaria.org.

  3. Payment of the registration fee can only be made by credit card or bank transfer. By submitting your credit card or bank account details (“Payment Data”), you represent, and Ascenion will assume, that you are allowed to use your Payment Data in order to pay the registration fee, in particular if payment is made with a company credit card or via a company bank account. Even if you register within the scope of your employment contract and/or payment is made with a company credit card or via a company bank account, you remain personally liable to Ascenion for payment of the registration fee.

  4. Ascenion has contracted a service company to arrange for the credit card payments and to organize the necessary flow of funds between the banks involved and/or the respective credit card company (in the following: “Institutions”). By submitting your Payment Data, you agree to data storage and to data processing by the Institutions for the purpose of processing your payment of the registration fee. Your Payment Data will only be provided to the Institutions and not be provided to Ascenion unless your credit card company or your bank refuse payment of the registration fee or there is a revocation of payment under applicable law as well as credit card or banking terms. If you have question regarding protection and/or handling of your Payment Data please contact Ascenion at info(at)biovaria.org.

  5. By submitting your Payment Data, you agree to data storage and to data processing by the Institutions for the purpose of processing your registration. The same applies to personal data and contact data submitted with the registration (Contact Data), including name and affiliation, business address, business telephone and fax number and business email address. In addition to this, your Contact Data will only be used as follows: (i) Ascenion will produce a participant list stating your name and company name (i.e. affiliation) based on the information submitted with your registration. If you did not check the respective box in the registration process, Ascenion will assume that you agree that your name and affiliation will be processed, stored and published for purposes of the participant list which will be handed out to all participants on the days of Biovaria 2017. In case you decide later that your name and affiliation shall not be displayed in the participant list, you may advise Ascenion accordingly in writing or by email to info(at)biovaria.org but in no event may this notice be given any later than April 10, 2017. (ii) Apart from the participant list, your Contact Data will only be used for the purpose of distributing information relating to upcoming BioVaria events and will not be used for any other invitations or mailings and, in particular, will not be made available to any third party. In case you decide that your Contact Data shall be deleted, you may advise Ascenion accordingly in writing or by email to info(at)biovaria.org at any time starting one month after Biovaria 2017.

  6. By confirming your registration, you agree that Ascenion is entitled to use the photos of participants which are taken during BioVaria 2017 and showing you for marketing and communication purposes, particularly on its websites www.biovaria.org and www.ascenion.de. You may revoke your consent at any time in writing, addressed to Ascenion (cf. Section 2 above), or by email to info(at)biovaria.org.

  7. In order to guarantee the early registration discount (deadline 29 March 2017) payments must be received by 5 April 2017. Cancellations must be made by sending an email to info(at)biovaria.org which must be received by Ascenion at the latest by 5 April 2017 in order to receive a refund of the registration fee (minus a processing fee of 50 Euros). Refunds will be paid out after BioVaria 2017 (22 - 23 May 2017). No refunds can be made for cancellations received after 5 April 2017. However, you may transfer your registration to a colleague from your organisation upon at least one week prior notice by email to info(at)biovaria.org. No-shows will still be billed for the full registration fee.

  8. Liability of Ascenion with respect to its duties and obligations under the contract established according to your registration is, to the extent legally possible, limited to gross negligence or intent. The same applies for Ascenion's liability for acts and omissions of its officers, employees, agents and contractors. In case Biovaria 2017 needs to be cancelled for whatever reason there shall be no claim against Ascenion, irrespective of its legal basis (contractual or quasi-contractual or pre-contractual, applicable law or equity), except for a full refund of the registration fee; all claims for damages or lost expenses shall be excluded. No limitation of Ascenion's liability shall apply in cases of bodily injury or damage to health, except if the respective act or omission is caused by an agent or contractor of Ascenion and this agent or contractor has been carefully selected and supervised by Ascenion.

  9. If any provision of these terms and conditions is held to be invalid or unenforceable, all other provisions will continue in full force and effect, and the invalid or unenforceable provision will be deemed to be replaced by a valid and enforceable provision which conforms as closely as possible with the original commercial intent of invalid or unenforceable provision. The terms and conditions may not be amended or modified, except in writing signed by both parties.

  10. The contract established according to your registration is exclusively governed by the laws of Germany under exclusion of any conflict of laws principle that would result in the application of the laws of any other jurisdiction. Any dispute, controversy or claim arising under, out of or relating to the contract established according to your registration and any subsequent amendments, including, without limitation, its formation, validity, binding effect, interpretation, performance, breach or termination, as well as non-contractual claims, shall be referred to and finally and exclusively determined by the courts of Munich, Germany.
